Suggest they familiarize themselves w/ Penn Central & Hackett—it is that straightforward of an application of constitutional property law as doubled down upon by SCOTUS—recently. You may be entitled to a great deal of compensation for that parking lot had to build twenty years ago—interest adds up. Could you build & rent out fewer units as a result? Wow—that is a lot of money real fast that may be entitled to from whatever jurisdiction’s local gov that took your property—partially, regulatorily, as an extraction or condition to build and limitation on right to exercise your constitutionally protected property & economic rights and liberties—including to the full economic beneficial use of your land including profits therefrom like rents. Bonus—this is real aggressive pro housing totally independent disparate legal actions that works in any US jurisdiction that has so taken property in this way—pretty much ever. No SOL on 5th amendment takings law (but not totally sure re any time limitations offhand which this very much so is). Not actively practicing law as all day every drudgery tracked & billed in six minute increments is not really my thing or all that compatible w/ my kind of getting to class at all was the hardest part of law school audlexic neurodivergence & should not be relied upon as legal advice. And bedrock constitutional property law is on the side of a revolution in land use for rule of law, democracy (eg addressing in part political segregation mediated by corporate consolidated & fear (but base over abstract but imminent & urgent as in a matter of continuity of civilization & life on earth at all) sells better than sex consumer driven flywheel of reality contouring media) and is desperately needed for reasons of housing, transit, economic & legally locked in climate catastrophe and climate in a variety of other ways & more too. Parking minimums and mandates are partial regulatory 5th Amendment takings requiring just compensation. Says me. Drafted US statements of law on the subject of 5th amendment takings law for the US DOJ’s ENRD Law & Policy Section for the OECD in another lifetime so I am the source for the cite it now I don’t like how your use of language, facts, reasoning and understanding of law makes me feel so it must be wrong cite your source now sorts—but only in that I am pointing towards Supreme Court constitutional jurisprudence that is eminently & squarely on point and about as certainly directly applicable as this kind of law can get assuming law is still law at all in the US.
