There are several states who enshrined these marriage bans into their state constitutions well before Obergefell and because of that there are several layers of legislation they have to go through in order to amend their constitution. The RFMA only applies to federal recognition

y'know, the wording on that makes SO much more sense why the RFMA was passed in 2022. I've always kinda thought it was unnecessary/redundant and more of a 'I'll pass this for the hell of it because I can' thing but that kinda makes a good case for it

If the Church supports having gay marriage as the law of the land and as a “right” in and of itself, why did it refuse to support previous bills seeking to instantiate this “right?” Why did it specifically choose to get behind the RFMA?

Returning to this chart I made in 2024. There were 27 GOP senators who voted for at least one major Dem priority from 2021-2022 (impeachment, infrastructure, gun deal, CHIPS, RFMA). Come next year, most could be gone. 6 have already retired, 5 are retiring this year, 1 (Cassidy) has been defeated, 1 more (Cornyn) is likely on his way, and 2 (Collins, Sullivan) are in tough fights this year. Next Dem president will face a much different Senate GOP

We know it's legal, but SCOTUS has been repealing protection laws & could come after Obergefell soon. When that happens (like abortion) there will be trigger laws. PA won't have one now. At least RFMA repealed DOMA, so that also helps. Thanks Democrats!

Did you miss the RFMA completely? As for abortion, the only time that could have happened in theory was when Dems had a super majority for like 11 months in 2009 when there were about 40 in the House and 10 in the senate that made Manchin look like a communist. Are you just 25?

conservatives do not need RFMA to argue religious institutions cannot be forced into same-sex weddings; the First Amendment already gets them most of the way there. please be serious

the Equality Act did not, and would not, have addressed gay marriage. Congress cannot force states to issue a marriage license, it would be a very clear 10th Amendment issue if they attempted. Leveraging powers under Full Faith and Credit that forces states to recognize marriage issued in other states is the only tool Congress has in that area, as done in the RFMA.

yeah but if you’re a resident of montana, hop over to washington to get married, montana has to recognize your marriage, whether it’d be allowed in montana or not. that’s just the full faith and credit clause, RFMA just specifically clarified that it applies to gay marriage

Still not the same thing as codifying Obergefell. I get it has the same outcome in practice, but the moral message this sent was not the same that Obergefell did: you cannot discriminate against same-sex couples. RFMA is a backstop, but would allow states to limit marriage.

rfma doesn’t codify obergerfelle, it just insures states must recognize the legality of the marriage as long as it was performed in a place where it is legal.

RFMA goes as far as Congress can go in regards to gay marriage, without a Constitutional amendment or standing court ruling like Obergefell.

Susan Collins was the passing vote on the Obama Stimulus and Dodd-Frank, and without her the RFMA never would have passed
The only time Susan Collins bucked her party line when it actually mattered was the 2017 Obamacare repeal and even then she probably didn't even know John McCain was going to tank it.

Minor note on the RFMA, it protects existing gay marriages. If Obergefell falls, states can still ban it. They're just required to respect them if the marriage is ratified while/where it's legal.

Under the RFMA, gay couples could get legally married anywhere in the US even if Obergefell was overturned. I would say that counts as effectively codified. If they went any further the Supreme Court could strike it down because marriage is a state issue.
