Crucial condition is that the original party HAS TO MERGE with another party or THEY HAVE TO MERGE with another party. NO LEGAL PROVISION of a ‘separate group’ inside Parliament or inside the assembly while sitting on a MP/ MLA seat previously won on the ORIGINAL PARTY’s name and symbol. The LAW IS CLEAR. NO “ SEPARATE GROUP” inside the House on the same symbol is legal. MERGE with a new party or be DISQUALIFIED. Else your membership of the House - parliament or assembly - is ILLEGAL.

The complaint was never taken cognizance of, and she was only named as a respondent & "not as an accused." Unfortunately the Hon'ble Supreme Court had already dismissed her plea. This is how the system screws you & the opposition lost a fair seat! I agree she was done in by some people but the institutions should protect the weak not allow for manipulation!

What happened in the case of INC Meenakshi Natarajan’s Rajya Sabha seat in Madhya Pradesh is of power grab, plain and simple. What is worse is the abdication of responsibility by Election Commission and with all due respect, the Hon. Supreme Court. After the dismissal by SC, the news followed was of the Hyderabad court returning the complainant’s petition claiming that it has no jurisdiction. Remember no FIR, ‘accused’ at number 4 in a petition , HC has now returned the petition.. yet it was a RO who rejected it on flimsy grounds without even consulting the central EC. Who messed up in filing the form can continue to be debated, who passed on the information to who can be talked about however the bottom line is a neat seat was lost by those very agencies that need to uphold Constitution and Democracy.
