“Sometime after the Taliban's rise to power in Kabul, Constellis left the country, abandoning its property, including the Constellis Containers, at Camp Oryx without notice to Oryx.
Constellis did not give Oryx the keys or access to the Constellis Containers before leaving Afghanistan.
26. After assuming control of Afghanistan, the Taliban conducted inspections of all
sites associated with the USG, including Camp Ory. The Taliban demanded access to the Constellis Containers and broke the locks to inspect them.
27. After being forcibly opened by the Taliban, it was discovered (for the first time)
that the Constellis Containers contained, inter alia, over 300 weapons (including hand grenades) and ammunition. None of these weapons (or ammunition) had been registered with the now former) Afghan government.
28. The weapons discovered in the Constellis Containers included M4 carbines,
Kalashnikov rifles, pistols, and hand grenades.
29. The Taliban immediately seized the war material found in the Constellis Containers, stating that they were taking the "ammunition...and explosive weapons" that were identified as belongine to the "Constellis American Securitv comnanv."
