I'll repeat something I said in April, but a lot of conservatives on Twitter either play a motte and bailey on legislative intent and legislative history or don't know Scalia's actual position on it. He railed against it and repeatedly refused to join opinions citing it.

Justice Thomas, joined by Justice Gorsuch, concurs in full. But Thomas calls into question yet another doctrine. Thomas contends that judicial estoppel may have questionable legal basis. Reassessing that doctrine would create significant ripple effects across jurisprudence.

Josh Barro on Platner: “Graham Platner doesn’t work for a living. As The New York Times reports, the bulk of his income comes from a military disability pension of approximately $60,000 a year. The pension doesn’t mean he’s too disabled to work — he is, after all, currently seeking the job of U.S. Senator — but his recent non-campaign endeavors seem more like hobbies than a career. He runs an oyster farm that principally sells oysters to his mother’s restaurant. He earned a small stipend as his town’s harbor master: $3,000 last year. He lives in a $205,000 house that he bought with a $200,000 loan from his father.” What a resume.

There is no corroborating evidence Brett Kavanaugh and Christine Blasey Ford ever met. All four people who Ford said were at a party where the alleged assault occurred, including her close female friend, said there was no such party. The close friend also said she didn’t believe Ford’s story, and that she told the FBI Ford’s allies threatened her with a smear campaign if she refused to lie and confirm it.
The allegations against Platner are better corroborated than the allegations against Brett Kavanaugh were and it will be interesting to see who manages to be consistent in their beliefs about such things.

Fifield sent a text in August referring to Platner having a Nazi tattoo. But Platner has been saying he didn’t know its meaning until October. How is this not conclusive that Platner has been lying through his teeth? Did she get in a Time Machine to send the text?
