Smith, herself, used those rights to extinguish the claims of 400,000 Alberta pensioners when they wanted to sue AIMco for losing $2.1 billion of their savings in the VOLTS debacle. Smith could use the same powers to extinguish the coal company claims. She just chooses not to.
