What are we doing
SUMMARY OF H-1B EXECUTIVE ORDER - ENTRY BAN: No H-1B visa holder may enter the United States beginning Sunday September 21st, including current visa holders, unles they pay $100K to enter. - VISA FEE: New H-1B and H-1B extensions must pay 100K to be processed and 100K per year every year thereafter to maintain them. This will effectively end the H-1B program completely. No one, even the highest paid at 500K will be paying an extra 100K a year to the government. It will destroy the health care, higher education, and technology sectors as we know them if this isn't struck down in court.

Seems fair!
I haven't been as critical of Noem v. Vasquez Perdomo as some (and have agreed with a lot of what @OrinKerr and @RichardMRe have written) but the latest @steve_vladeck post makes some really powerful points. E.g.:

Nah. For the sake of market stability, any removal needs to be handled as for cause.

The Trump administration is asking the Supreme Court to allow it to resume "roving" immigration raids in Los Angeles. Government says that "speaking Spanish or working in construction...can heighten the likelihood that someone is unlawfully present in the United States."

This is inaccurate…quite so. The report should be retracted.

Yes, recently. SCOTUS unanimously vacated an injunction in the ghost guns litigation entered by Judge O'Connor after the Court already stayed a prior injunction. Although it wasn’t called a “clarification.” Application: justsecurity.org/wp-content/… Order: supremecourt.gov/orders/cour…
Has SCOTUS ever had to "clarify" or check a lower court for ignoring an order before?

Fairly disappointed with Justice Jackson's dissent in Trump v. CASA. Her claim that Congress is “powerless” to limit federal court remedies contradicts Article III. Congress can define lower court jurisdiction and carve exceptions to SCOTUS’s appellate reach.

In my lifetime, the greatest civil rights achievement has been the widespread legal recognition and societal acceptance of gay people.
As we near the 10th anniversary of SCOTUS making same-sex marriage legal, polling shows even Republicans today say: let it be. Live and let live. nytimes.com/2025/06/22/opini…

True.
The Supreme Court is seriously at risk of overturning International Shoe in my lifetime and that is going to be my villain origin story.

The Biden administration committed malpractice by appealing this case. They are pretty lucky that Roberts didn’t hold transgender status is not a suspect classification.

NEW: In U.S. v. Skrmetti, a closely watched case on a Tennessee law barring certain medical care for transgender minors, the court holds that Tennessee's law can remain in place.

Whatever fleeting political gain Senator Lee imagined he’d get from this, it’s disgraceful, and in any functioning political system, it would warrant a formal censure from his colleagues. Elected officials should never joke about shootings of other elected officials.
