Important EHRC Consultation Open Now: Technical Guidance for Schools 2026
The Equality and Human Rights Commission (EHRC) has launched a major public consultation on updated technical guidance for schools in England, Scotland, and Wales.
This guidance explains schools’ legal obligations under the Equality Act 2010 (Chapter 1, Part 6) not to discriminate against, harass, or victimise pupils on the basis of protected characteristics. It is not a statutory code, but it can be used as evidence in legal proceedings.
The updates cover:
📝Developments in the law on discrimination and protected characteristics
📝How the Act applies in different settings (academies, special schools, school-based clubs, etc.)
📝Interaction with other laws
📝Specific scenarios like restraint, isolation, and seclusion
📝Nation-specific differences across England, Scotland, and Wales
We have published updated technical guidance that explains schools’ legal obligations not to discriminate against, harass or victimise pupils, as set out in chapter 1 of Part 6 of the Equality Act 2010.
We are running a consultation on this guidance:
