#trademarks for CANFIRST in connection with real estate investment and management services, registered October 4, 2023. The Complainant’s
#website uses the domain name CanFirst(.com). The Complainant contends that “the ongoing and continued confusion of the public that the Complainant owns or is somehow tied to the Infringing .Net Site is causing serious, significant and irreparable harm to the Complainant, its brand, reputation and business.” The Respondent did not file a Response.
Held that the
#UDRP is not a forum for resolving trademark infringement claims absent evidence of bad faith registration and use. In this context, bad faith registration and use generally must involve specifically targeting the Complainant’s
#trademark rights and goodwill. The Complainant has not provided the requisite level of supporting evidence necessary to make its case under the UDRP, which as aforesaid must be of a different nature than the kind of evidence necessary to make a mere infringement claim. Read @
