A Landmark Verdict: Digital Data is Now Heritable Property: ટેકનોલોજીના આધુનિક યુગમાં વ્યક્તિના મૃત્યુ બાદ તેની ભૌતિક સંપત્તિના વારસા વિશે તો આપણે સૌ જાણીએ છીએ, પરંતુ તેના ડિજિટલ ડેટાનું શું? આ જટિલ પ્રશ્ન અગે ગાંધીનગરની કોર્ટે એક સીમાચિહ્નરૂપ ચુકાદો આપ્યો છે. ગાંધીનગરની કોર્ટે સ્પષ્ટ કર્યું છે કે મૃતક વ્યક્તિનો આઈફોન, એપલ આઈડી અને આઈક્લાઉડ એકાઉન્ટમાં રહેલો ડેટા એ તેમની ‘વારસાગત એસ્ટેટ’નો જ ભાગ છે અને તેના પર વારસદારોનો કાનૂની હક્ક છે.
શું હતો સમગ્ર મામલો?
આ કેસની વિગત અનુસાર, એક વ્યક્તિના અવસાન બાદ તેમના પરિવારને આઈફોન અને આઈક્લાઉડ એકાઉન્ટમાં સંગ્રહિત ફેમિલી ફોટોગ્રાફ્સ, વિડિયોઝ, મહત્ત્વના દસ્તાવેજો અને વોઇસ નોટ્સની જરૂરિયાત ઊભી થઈ હતી. જ્યારે પરિવારે આ ડેટા મેળવવા માટે ટેક જાયન્ટ 'એપલ' (Apple) કંપનીનો સંપર્ક કર્યો, ત્યારે કંપનીએ સુરક્ષા અને પ્રાઇવસીની નીતિઓ ટાંકીને કોર્ટના સત્તાવાર આદેશ વગર ઍક્સેસ આપવાનો ઇનકાર કર્યો હતો. આખરે, ન્યાય મેળવવા માટે પરિવારે ગાંધીનગરની અદાલતમાં 'ઈન્ડિયન સક્સેશન એક્ટ' હેઠળ અરજી દાખલ કરી હતી.
કોર્ટનું મહત્ત્વનું અવલોકન: પ્રાઇવસી અને મિલકતનો અધિકાર
આ કેસમાં કોર્ટે ‘મિલકત’ની વ્યાખ્યાને આધુનિક સંદર્ભમાં વ્યાપક બનાવી હતી. કોર્ટે નોંધ્યું કે, ડિજિટલ ડેટામાં માલિકી હક્ક અને મૂલ્ય જેવી મિલકતના તમામ મૂળભૂત તત્ત્વો રહેલા છે, તેથી તેને વારસાગત સંપત્તિ ગણવી જોઈએ. વ્યક્તિગત પ્રાઇવસીનો અધિકાર વ્યક્તિના મૃત્યુ સાથે સમાપ્ત થાય છે અને તે તેના કાનૂની વારસદારોને ડેટા ઍક્સેસ કરતા રોકી શકે નહીં. આજના સમયમાં વ્યક્તિનું જીવન ડિજિટલ ઇકો સિસ્ટમ સાથે અતૂટ રીતે જોડાયેલું હોવાથી ડિજિટલ વારસો અનિવાર્ય છે.
અરજદારના એડવોકેટની દલીલો
અરજદાર તરફથી આંતરરાષ્ટ્રીય કાયદા અને 'ડિજિટલ એસ્ટેટ જ્યુરિસ્પ્રુડન્સ'નો સંદર્ભ આપીને સમજાવાયું હતું કે, ડિજિટલ એસેટ્સનું સંચાલન પરિવાર માટે માત્ર આર્થિક જ નહીં, પરંતુ ભાવનાત્મક રીતે પણ અનિવાર્ય છે. કોર્ટે આ દલીલો ગ્રાહ્ય રાખી મૃતકની પુત્રીને ‘લેટર્સ ઓફ એડમિનિસ્ટ્રેશન’ મંજૂર કર્યા હતા.
એપલ કંપનીને ટેકનિકલ સહાયનો આદેશ
આ ઐતિહાસિક ચુકાદામાં કોર્ટે એપલ કંપનીને આદેશ આપ્યો છે કે, તેઓ વારસદારોને ડેટા રિકવરીમાં જરૂરી તમામ ટેકનિકલ સહાય પૂરી પાડે. આ નિર્ણયથી ભવિષ્યમાં સોશિયલ મીડિયા એકાઉન્ટ્સ, ઈ-મેઈલ્સ અને ક્રિપ્ટોકરન્સી જેવા ડિજિટલ વારસાના કેસોમાં એક નવી કાનૂની દિશા મળશે.

A workshop on “Balancing Transparency and Privacy: A Harmonious Construction between Dissemination and the Digital Personal Data Protection (DPDP) Act, 2023” was held today at Shastri Bhawan, New Delhi. The workshop aimed to create awareness among officials of DoSEL on data protection, privacy rights and compliance requirements under the Digital Personal Data Protection (DPDP) Act, 2023, while ensuring alignment with Open Government Data (OGD) principles.
The session included deliberations on the salient features of the DPDP Act and compliance requirements by Shri Goyal from Ministry of Electronics and Information Technology (MeitY), a presentation on DoSEL’s data systems covering maintenance, storage and dissemination by Dr. Pankaj KP Shreyaskar, DDG (Statistics) and a discussion on techno-legal challenges in public data compliance by Dr. Pavan Duggal, Advocate, Supreme Court of India.

आज तक के साथ बातचीत के दौरान, सांख्यिकी एवं कार्यक्रम कार्यान्वयन मंत्रालय के सचिव डॉ. सौरभ गर्ग ने “वॉक द टॉक” प्रोग्राम में आधार वर्ष संशोधन पर विस्तृत विचार साझा किए। उन्होंने स्पष्ट किया कि जैसे-जैसे अर्थव्यवस्था आगे बढ़ती है, सही माप के लिए आधार वर्ष में समय-समय पर बदलाव ज़रूरी है। इसलिए, GDP और IIP के लिए 2022–23 को नया आधार वर्ष और CPI के लिए 2024 घोषित किया गया है, जिसमें एक्यूरेसी को बेहतर बनाने के लिए GST, PFMS और दूसरे डिजिटल डेटा सोर्स को शामिल किया गया है।
