Hello Twitter/X community, I'm reaching out to my network, particularly
#Founders and
#Entrepreneurs, as well as those with experience working on an
#H1BVisa or obtaining a
#GreenCard. I'm seeking your valuable insights on a situation impacting a friend of mine, whom I'll refer to as Alex for confidentiality purposes.
Alex's Situation:
- Alex recently transitioned to a new job in the United States on an H-1B visa.
- His new employer is in the process of initiating their Green Card application to become a Permanent Resident.
- He has requested a work experience letter or an I-140, from his former employer. This letter needs to be signed on company letterhead, verifying the dates he was employed, his work responsibilities, and the experience he gained while on the job.
As a part of his application process, this letter has already been drafted and the only remaining step is to have it printed and signed by his former employer.
My friend's previous company has had a tremendous reputation for being a great place to work. The company received awards for being a top local employer and other awards for the quality of work they do. At the same time, the point of contact at this company has been unresponsive in fulfilling this simple request.
My friend has reached out to this point of contact through various channels and finds himself in a challenging position. All of his other employers have accommodated this request without issue. Without this letter of experience, his Green Card application may be seen as less compelling and my friend may risk having their application denied. This would impede his ability to become a Permanent Resident and could get in the way of applying for United States Citizenship at a later date.
While there is no legal requirement for Alex's past employer to comply with this request, I would be immensely grateful for any recommendations or insights from my network on how best to navigate this situation. If you've encountered a similar experience or have any expertise in this area, your guidance would be immensely valuable.
