Dr. Pant, an expert on GATS, provided a comprehensive overview of the structure and core disciplines of the General Agreement on Trade in Services (GATS), including scope and definitions, general obligations such as Most Favoured Nation (MFN), transparency, and domestic regulation, alongside sectoral scheduling commitments on market access and national treatment. She also highlighted the growing significance of services trade in the multilateral system, particularly in the context of digitalisation, which has expanded the tradability of services across borders. A central focus of the session was on the scheduling of commitments, including the identification and inscription of various market access limitations such as restrictions on the number of service suppliers, value of transactions, operational scope, employment of natural persons, legal entity requirements, and foreign equity participation. The session further emphasised the critical role of domestic regulatory frameworks, noting how indirect measures can significantly influence services trade. The evolving draft texts are at a very raw stage and require further technical engagement and constructive dialogue among members. In the interim, the Multi-Party Interim Appeal Arbitration Arrangement (MPIA), established by a group of WTO members, continues as only a temporary mechanism that is not gathering increased support.
