Many factors deter pts from commencing or continuing legal action against the med profn inc: cost, speed, the length of time it can take to be resolved, difficulties in obtaining evidence such as pt notes, the very high evidential bar and the trauma of reliving their experience

I didn’t say it bailed them out, it pays compensation. I understand that having a major settlement against a doc’s name may not be good for their reputation or career prospects. What I was trying to say is I think the fear of litigation is not well-founded - for many reasons

I think that is a fair warning. “Mediation” and “lessons learned” can become institutional language that hides harm rather than exposes it.
