I came across a new trademark dispute that is unfolding in Nigeria from @legallysavvy_ng page on LinkedIn, involving the Fastest Cakes brand, which has held a registered trademark since 2021. The company is challenging the business name registration of "Fastest Cake," a business based in Ibadan that was launched in April 2025. The matter has been brought before the Corporate Affairs Commission, which has issued a delisting notice to the alleged infringing business. Interestingly, a few weeks ago, we had the case of KPMG Nigeria against KPMG Professional Services, where the Court of Appeal directed CAC to remove its business name from the Commission's register, thereby highlighting the need for Nigeria to adopt a dual registration system between CAC and Trademark Registry to avoid registration of identical names which maybe viewed as an act of bad faith concerning trademark rights in Nigeria.
