This order would flunk every part of an administrative law exam. There’s no standing. Plaintiffs have no cause of action. The matter is clearly committed to agency discretion by law. The judge is substituting her own judgment for that of agency. It’s pure lawlessness—and an indication why, properly understood, the APA does not authorize individual district judges to afford nationwide relief.

As someone who clerked for a federal district court judge in that courthouse and then worked there for several years as an AUSA, it is shocking to hear about such conduct. She is a disgrace and should resign. If not, she should be impeached.

After the SFFA v. Harvard decision, many universities indicated they would try to find ways around it.
UC Davis Med, which had already developed a way to get around California’s affirmative action ban, went further, offering to teach other schools how to do it.
Post-SFFA, the architect of their “Davis Scale,” which uses socioeconomic factors to admit racially diverse classes, “was asked about being sued over his legally questionable methods. He replied, ‘Am I worried about it? Yes. Is it going to stop me? No.’”

Well now, look what we have here. Something advertising itself as a "center for the defense of academic freedom" is gearing up a campaign of vilification against programs that are revitalizing civic education at colleges and universities around the nation and helping to ensure that students are exposed to a diverse range of viewpoints. I suppose it's not surprising that people who have enjoyed a virtual ideological monopoly would fight tooth and nail to keep it. That's how monopolists work.
