Palestine Action is in good company. British governments and courts criminalised resistance to slavery, the Chartist movement for universal male suffrage, any organising by trade unionists, and the Suffragette movement to win women the vote. None of our rights were given to us by the ruling class. We had to fight for each of them tooth and nail. The British establishment is always on the wrong side of history, because history is with the struggle of ordinary people, not with the selfish interests of the billionaires and war industries. Those earlier struggles were deemed the terrorism of their day by the very same "liberals" – the British establishment and its useful idiots – who today declare any practical action to stop British complicity in Israel's genocide to be terrorism. Note too as proof of bad faith: the British establishment is well advanced in its efforts to declare entirely peaceful protest – marches through the streets – as anti-social, hate crimes and soon enough terrorism too. The ruling class consider attempts to stop a genocide, even holding a banner against the mass murder of children, to be far worse than racist pogroms in Belfast, which try to burn alive people in their homes because of the colour of their skin.

Today the Court of Appeal upheld the Labour government’s proscription of Palestine Action by saying they aren’t a peaceful civil disobedience group like the suffragettes and that Elbit Systems, Israel’s largest weapons manufacturer, is "a company pursuing a lawful business." The suffragettes bombed the Chancellor's house, planted a bomb outside the Bank of England, burned down churches and train stations, and smashed up art galleries. Palestine Action destroyed drones used to kill Palestinians in Gaza because Elbit's “lawful business” is arming a genocide. The British state is rewriting history and dismantling our legal system to protect Israel, a genocidal apartheid state.

Anyone who cares about our civil liberties should be alarmed about the outcome today. Years of imprisonment and sentenced as terrorists — with 15 years on license — after no charges or convictions of terrorism. All this while the UK continues to send arms to a state that is committing the gravest of crimes against humanity.
Four of the Palestine Action protestors have been convicted by jury of criminal damage. At no point was it put to the jury that the judge may sentence them as terrorists. Apartheid South Africa and Nazi Germany needed compliant judges to provide a legal veneer to their darkest crimes. Judge Johnson joins their wretched company. He overturned a jury's conviction of four anti-genocide activists for criminal damage and sentenced them as terrorists instead. As one their barristers pointed out, the four defendants were initially arrested by police on suspicion of involvement in an act of terrorism. But the prosecution decided not to charge them with terrorism offences because it knew no jury would ever convict them based on the evidence. Instead the Crown held two trials: a sham one for the jury, and the real one conducted in secret by the judge. That is not justice. It is a show trial worthy of the worst tyrannical regimes.

Today four activists face terror-related sentences for taking direct action against an Elbit Systems weapons factory in Filton, Bristol - a factory that makes drones sent to the genocidal apartheid state of Israel to kill Palestinians in Gaza. Back in April, I warned in Parliament that jurors would not be told terrorism sentences could follow a criminal damage conviction. No terrorism charges were ever brought. The proscription against Palestine Action has since been ruled unlawful. The defendants were even prevented from telling the jury they acted to stop genocide. This is a Labour government defending Israeli death factories and stripping away all of our fundamental rights. Everyone who cares about our democracy should be outraged.
