Sam is right. The Sorsby case didn’t enable the Tristan Smith case or other prior cases where eligibility rules were enjoined b/c of irreparable harm to an athlete. It’s inconsistent application of NCAA rules & the model in general. Sorsby is being used as a political pawn.
Lumping in Tristan Smith -- whose only crime was being too good to redshirt and being born a year too late for the Pavia waiver and a year too early for the new five-in-five rule -- with Sorsby is kind of gross. And no, the Sorsby decision didn't enable the Smith decision.

It’s an interesting issue because of the nature of the MMR partners. From what I heard at @NACDA, many of the folks at CSC don’t have backgrounds in advertising / licensing industry. Throw in the fact that MMR partners are usually included in recruiting conversations and you can see why they’re confused.
I listened to most of the hearing today. My thought is that it was missing a lot of context and real world info on how the CSC is making the “associated entity” determination and which businesses beyond MMR companies it is deeming as associated entities.

And, here we go. 17 states, including California, Ohio, Michigan, Pennsylvania and Tennessee, challenge the rev share “cap” and claim that it violates their respective state NIL laws. Another one to watch.
A new antitrust lawsuit against the NCAA seeks to lift revenue-sharing restrictions in 17 states, arguing the $20.5M cap established under the House settlement violates state NIL laws. The suit names the NCAA, Power Four conferences and the College Sports Commission as defendants, per @USATODAY. MORE: ow.ly/o4e950Z9YUn

What a great panel at @NACDA on changing and developing roles within college athletics! In order to evolve, we must adapt! #NIL #collegesports

Just finished up speaking with a great panel at @NACDA on how important the ability to adapt and pivot is going to be within an athletic department - never a dull day in college athletics
A new class-action lawsuit has been filed in California against the NCAA, power leagues and College Sports Commission, claiming the new NIL clearinghouse violates state statutes and federal laws and is a “conspiracy” to suppress athletes’ NIL earnings bit.ly/4xeb6oR

An amazing panel! I’m very grateful for @onuss_ helping get me involved in this event to allow for a unique athlete voice to be having more discussions w/ administrators making decisions! The unique position of professional athlete, recent college athlete, & sports law student give me a lot of lenses to advocate for athletes.
Amazing first panel with @samcehrlich @maynenic @HousetheMouse and @willhall3 for administrators on how to move forward thoughtfully in this post-settlement era.

Had a conversation with some old friends this evening about how everyone’s answer on #NIL has been “I don’t really know” - and we don’t! But at #AthleteCon this weekend, I was so pleasantly surprised to hear real ideas and actionable items from athletic administrators in the room

There were real issues being discussed in their day to day roles that they were trying to solve for. It really brought all of the “we’ll see” and “we don’t know” back to “what can we do right now to make a difference”

This roundtable session was an open mic session where administrators answered each others’ questions submitted prior to the discussion. I was thrilled to see how many admin really just wanted to learn and hear from eachother about how they’re improving their programs

Interesting development here.
After Thursday’s meeting, SEC and Big Ten are drafting suggested revisions to the Senate bill to be sent to congressional staff members, sources tell @YahooSports. A committee “markup” - the next stage in the process - is not expected until, at earliest, June 15 week.

I wrote a piece a while back on the compliance / review gap between 3rd party deals and rev share deals - right now, rev share deals are not evaluated for fair market value or valid business purpose. This bill would change that.
The joint statement from the SEC and Big Ten mentions a change to the revenue-share framework, which is a nod to an overshadowed provision in the bill that would require school rev-share payments to be submitted to the NIL Go clearinghouse.

As @WinterSportsLaw pointed out, this will likely result in less $ paid out to college athletes
