The American Innovation and Choice Online Act is back from the dead. It should have stayed in the grave. Since AICOA was first introduced in 2021, the U.S. tech sector has grown even more competitive, with AI companies no one had heard of in 2021 becoming some of the most successful companies in the world. What problem are we trying to solve here? AICOA copies many of its bad ideas from the EU Digital Markets Act. But that law should be a warning, not a template. Targeting firms by size, presuming common product design and platform-management decisions are harmful, and replacing evidence-based antitrust analysis with rigid regulatory commands -- these types of sweeping rules haven't reversed the EU's lack of technology leadership. I signed the coalition letter mentioned below opposing AICOA because America shouldn't follow Europe into stagnation. AICOA would also weaken the United States' hand as it pushes back against foreign digital regulations that discriminate against American technology companies. Congress should reject this bill and preserve the market conditions that have made the U.S. technology sector the world's leader.
AICOA was reintroduced in Congress yesterday. ITIF and @ACTonline sent a letter signed by 30 organizations and individuals to @ChuckGrassley and @SenatorDurbin explaining that AICOA would not promote innovation or choice, but it would actively undermine both.

ALEC Action encourages Congress to reject the American Innovation and Choice Online Act #AICOA. Instead of importing flawed European competition policy directly from the #DMA, Senators must promote policies that reward innovation, allow consumers to decide which products and services best meet their needs, and avoid picking winners and losers in the digital marketplace.
