Think European regulation stays on that side of the pond? Think again.
The U.S. Supreme Court delivered a huge victory for free speech last week. But don't forget what happened to Päivi Räsänen at the Supreme Court of Finland just five days earlier. @ADFLegal and @ADFIntl continue working to root out censorship on both sides of the Atlantic. ADF Senior Counsel, @AH_Gaiser, explains.

WATCH: "@eu_commission has been quite explicit. They don't like @X. They don't like @elonmusk. It seems personal and they're coming after him." ADF Senior Counsel, @AH_Gaiser sat down with @benleo on @GBNEWS over the weekend to discuss the first fine levied under the EU's Digital Services Act.

If a foreign government can slap a $140M muzzle on the largest free speech platform in the world, imagine what that means for your freedom of speech! ADF is supporting @X in its challenge to the @EU_Commission fine under the DSA. DSA doesn't stand for Digital Services Act. It stands for Delete. Silence. Abolish.

🔥Top-shelf move by @POTUS and @StateDept For 250 years, this is what America does. Common Sense. Radio Free Europe. A City on a Hill. Now: Freedom.gov. If Europe’s bureaucrats don’t want you to see it, that tells you everything. Because even if your government fears freedom — ours doesn’t.
JUST IN - U.S. State Department is developing an online portal that will enable people in Europe and elsewhere to access content banned by their governments including "hate speech and terrorist propaganda," the site will be hosted at freedom.gov — Reuters

The E.U.'s ongoing efforts to "Destroy, Abolish and Delete" free speech across the globe has put it on a collision course with the U.S. American companies like @X, @Meta and @Alphabet can't be unfairly regulated and punished abroad, and it's clear @POTUS has no intention of allowing this to happen unchecked. As @USTradeRep makes clear, the EU commissioners are fast approaching the "Time for Choosing." Let's hope they choose wisely and respect free speech for all.
The European Union and certain EU Member States have persisted in a continuing course of discriminatory and harassing lawsuits, taxes, fines, and directives against U.S. service providers. U.S. services companies provide substantial free services to EU citizens and reliable enterprise services to EU companies, and they support millions of jobs and more than $100 billion in direct investment in Europe. The United States has raised concerns with the EU for years on these matters without meaningful engagement or basic acknowledgement of U.S. concerns. In stark contrast, EU service providers have been able to operate freely in the United States for decades, benefitting from access to our market and consumers on a level playing field. Some of the largest EU service providers that have hitherto enjoyed this expansive market access include, among others: — Accenture — Amadeus — Capgemini — DHL — Mistral — Publicis — SAP — Siemens — Spotify If the EU and EU Member States insist on continuing to restrict, limit, and deter the competitiveness of U.S. service providers through discriminatory means, the United States will have no choice but to begin using every tool at its disposal to counter these unreasonable measures. Should responsive measures be necessary, U.S. law permits the assessment of fees or restrictions on foreign services, among other actions. The United States will take a similar approach to other countries that pursue an EU-style strategy in this area.

Likewise! A pleasure to speak with you!
Thank you very much @AH_Gaiser for our conversation on freedom of speech. It was a pleasure to broaden my collaboration with @ADFIntl beyond Europe.

Case closed. This is how responsible companies operate. 👏 Everyone—individuals and businesses—makes mistakes. What matters is whether they’re willing to correct course. BKV Corporation did exactly that. Instead of doubling down on a bad (and unlawful) policy, it listened to an employee courageous enough to speak up and then made it right. Business leaders and C-suite executives should follow BKV's lead and do their part to respect freedom of speech and conscience in the workplace. thefederalist.com/2025/12/12…

A high school student in Charlotte, NC, got permission to paint her school’s spirit rock in honor of Charlie Kirk. School officials then did an about-face, painting over the message, accusing her of vandalism, and calling police—just to start. We’re helping her sue. ⬇️

REPEAL THE DSA
The outrageous fines on @elonmusk and @X are sadly no suprise to those who’ve been sounding the alarm on the DSA: an EU law empowering Brussels to police the world’s speech online. (See this open letter from October.) Global pressure must be applied: repeal the DSA.

This is the way. 👇👇👇 @UnderSecPD is the latest in a steadily growing line of @POTUS officials (including @JDVance and @SecRubio) to stand against censorship from the UK and EU. We need more of this. And we need decisive action from Congress. @ADFLegal and @ADFIntl will continue to do our part providing guidance and solutions to US officials in Congress and administration officials who are best positioned to protect free speech in the face of foreign censorship threats.

This is exactly what so many of us have been warning about. The EU sees @X as little more than a tool for censorship. Good on @SecRubio for sounding the alarm. (@JDVance and @UnderSecPD are doing the same.) US officials MUST NOT allow Brussels bureaucrats to bully US companies and citizens into silence.
The European Commission’s $140 million fine isn’t just an attack on @X, it’s an attack on all American tech platforms and the American people by foreign governments. The days of censoring Americans online are over.

Honored to testify at PCLOB’s debanking public forum. Americans’ privacy and civil liberties shouldn’t stop at the door of their bank! Grateful to my colleagues @Jeremy_Tedesco and @brianrknight for their work restoring bank accounts for @ADFLegal clients.

HAPPENING NOW: My colleague @AH_Gaiser is joining @SamuelBrownback to brief executive branch officials at @PCLOB_GOV on the trend of discriminatory debanking. Too many conservatives and Christians — including Ambassador Brownback and even @POTUS — have been canceled or punished by their banks with little to no explanation. That should alarm every American. The good news? President Trump has moved to shore up protections at the regulatory level, and major institutions — @Chase, @BankofAmerica, @Citibank, @PNCBank — have already adopted important policy reforms to curb this kind of discrimination. Sunlight is the best disinfectant. Today's briefing should bring our elected officials one step closer to bringing about lasting change.

💥BREAKING: @Microsoft has now committed to fair treatment for religious nonprofits and pro-life pregnancy centers. As @Bloomberg reports, this is a major win for @ADFLegal and our partners at Bowyer Research (@JerryLeeBowyer, @IsaacWillour)—with a crucial assist from @AGJamesUthmeier. This decision finally levels the playing field for many faith-based nonprofits that have spent years on the outside looking in at Microsoft’s programs. And the change is real. Our friends at @HeartbeatIntl and others are already seeing concrete steps from Microsoft to honor this commitment. A big step forward—and we’re just getting started. bloomberg.com/news/articles/…

🚨🚨Digital ID is one of the biggest emerging threats to personal freedom. It isn’t a harmless tech upgrade — it opens the door to unprecedented government monitoring of speech, movement, and daily life. It’s exactly the kind of system aspiring autocrats dream about: centralized, trackable, and impossible to escape. And this isn’t hypothetical. Versions of it are already rolling out across the EU and the UK, where people face arrest every day over online “hate speech.” As @shellenberger has documented, U.S. tech giants like @Oracle are helping build the backbone of this system. Congress is back. The clock is ticking. Lawmakers must act now to protect Americans from Digital ID. A nation that submits to it doesn’t remain a free people—it becomes a nation of serfs.
🚨 ANOTHER “CONSPIRACY THEORY” JUST CAME TRUE — DIGITAL ID IS HERE Independent journalist Michael Shellenberger has uncovered exactly what the global elites are building — and it matches everything the WEF, UN, EU and UK have been quietly planning. Governments are now pitching Digital ID as a solution to: • “illegal immigration” • “ID fraud” • “streamlined healthcare” But Shellenberger warns the real danger is digital totalitarianism. China already uses Digital ID Social Credit to control speech, movement, banking and behaviour. And the West is following the same script: • First it’s voluntary • Then it becomes mandatory • First there are rewards • Then come the punishments He also exposed the single biggest threat the public isn’t being told: A centralised ID system creates a massive cybersecurity kill switch. If it gets hacked, they can access: Your bank. Your medical records. Your identity. Your entire life. All in one breach. This isn’t “convenience.” It’s a digital cage — and they’re building it fast.

Google's letter is truly staggering for so many reasons. Thanks in large part to the tireless efforts of investigative journalists like @shellenberger and @mtaibbi, we've known for years that the Biden administration was pressuring every Big Tech platform to censor speech on COVID, gender identity, election integrity and more. Meanwhile, the same administration was applying pressure in a very similar same way to major financial institutions like @BankofAmerica, @JPMorgan in order to punish and silence political opponents. That's what my @ADFLegal colleague, @BrianrKnight, and I testified about when we were called by @Jim_Jordan and @JudiciaryGOP. Rep. Jordan and his colleagues have worked tirelessly to expose and confront the Biden administration—and the corporations that capitulated—for this brazen assault on our God-given freedom of speech. No American should ever fear they'll lose access to the public square or their own finances just because of their peaceable views on faith and politics.

🚨🚨This is a game-changer. As @Jim_Jordan notes, @Google and @YouTube are not only reversing course on past censorship, but cleaning house to ensure it never happens again on their platform. Even better, Google is coming out swinging against the EU’s censorship regime known as the “DSA,” which silences Americans’ online speech in direct violation of the First Amendment. And no. We are not tired of winning!
🚨BREAKING: Due to our oversight efforts, GOOGLE commits to offer ALL creators previously kicked off YouTube due to political speech violations to return to the platform. BUT THAT’S NOT ALL. Thread:

YouTube warns that Europe could force companies to remove LAWFUL social-media content and could risk freedom of expression “within and OUTSIDE of the EU.” That’s right. Europe wants to censor your online speech even if you aren’t in Europe!
