LEGAL UPDATE: A Tennessee court recently agreed that an NDA is not enforceable in a case that preceded the 2018 law banning NDAs in civil child sexual abuse settlements. Jane’s toddler was sexually abused by a Sunday school volunteer in 2014. Jane and her husband settled a lawsuit regarding the abuse in 2016, but the settlement included an NDA that prevented them from discussing the allegations publicly. Two years later, in 2018, Tennessee enacted a law declaring NDA provisions that conceal claims of child sexual abuse to be void and unenforceable as a matter of public policy. Yet Jane and her family continued to live in silence. In 2023, the case was reopened on the premise that the 2018 state law should apply to the 2016 NDA. A Williamson County court has now ruled: Tennessee's law applies to her NDA - even though she signed it before the law existed. After a decade of being silenced, this family has had their ability to speak officially restored. But here's the hard truth: only six other states have protections like Tennessee's. And even in states that do, survivors may not know those protections exist or whether they apply to their specific circumstances. A federal version of Trey’s Law is actively moving through U.S. Congress and would close that gap. It would ensure survivors across the country have the same ability to speak the truth - no matter when or where their abuse occurred. OKLAHOMA UPDATE: Yesterday in Oklahoma City, the Senate adjourned without calling HB 4227 or SB 740 to a Floor vote, meaning “Trey’s Law” and the “Cindy Clemishire Act” did not pass this session. This legislation would have protected the voices of child sexual abuse victims by ending the weaponization of NDAs in civil settlement agreements – and also would have eliminated the deadline (statute of limitations) on prosecutors to pursue child predators responsible for sex crimes committed against minors in Oklahoma. Oklahoma is one of only six states that has not fully eliminated the criminal statute of limitations for child sexual abuse and trafficking cases (The others are OR, OH, NV, ND and NH). The criminal statute of limitations for sex crimes against children with a federal cause of action was eliminated in 2006. Still, Oklahoma’s Senate leadership declined to act on this glaring gap in their state laws. “We want to thank every legislator who listened to our voices, especially our incredible bill sponsors Rep. @Kannady4OK91Rep and Sen. @WeaverForLtGov. April is National #ChildAbusePreventionMonth. Although today marks the last day of the month, this critical work continues. With recent research out of University of New Hampshire citing 1 in 8 children in the U.S. will be sexually assaulted before their 18th birthday, we need to act NOW, with urgency, to protect victims’ voices.
