Another nail in the coffin of Bengaluru!? Another step by the Govt to convert Bengaluru into the IT SLUM of the world (if it isn't already?)... This @INCIndia sarkara in Bengaluru is backstabbing the city... repeatedly - one betrayal after another. Setting it up for a complete collapse! Our dear city is spiralling under dilution of laws by this Govt. The latest assault on Bengaluru by the Govt: Notification for One-time exemption from OC for Sites upto 2400SqFt with building upto G 3 or Stilt Parking G 3. There is a Supreme Court ruling in Dec 2024, which specifically says “Electricity, water supply, sewerage connection, etc., shall be given by the service provider / Board to the buildings only after the production of the completion/occupation certificate.” So, this notification is a direct contempt of the Supreme Court. Our politicians have no understanding of 'Rule of Law' or 'Constitutionality'. They only carry constitution in their pockets for marketing, they don't follow the law. At this rate, the slummification of Bengaluru will accelerate, looks like we are speeding to our doom. Citizens need to file a contempt petition in the Supreme Court against the Govt of Karnataka, for all these malicious orders that have been passed in the past few years: a) B to A khata conversion, b) Setback relaxation, c) Premium FAR, d) 15% deviation regularisation, e) Amendments of Zoning regulations in RMP 2015, f) OC exemption. These are not relief to citizens, these are relief to violators! Why should law abiding citizens and the city suffer in order to appease the law violators? All of them defeat the very basis of Planned Development. Bengaluru is already crumbling under the weight of Unplanned Devt. It cannot take any more. Why have laws at all if they are going to be diluted? We might as well scrap all laws, and let everyone do whatever they please. At least law abiding citizens are not make to look like fools..? It appears that the Government of Karnataka has learnt little from recent urban disasters and fire tragedies that have exposed the consequences of regulatory dilution and weak enforcement. Instead of strengthening compliance and ensuring accountability, the Government is once again proposing amendments that largely benefit real estate interests and effectively regularise or accommodate practices that were previously considered violations. Rather than enforcing planning norms in the larger public interest, the Government seems intent on weakening them. This creates a dangerous cycle: developers increasingly proceed on the expectation that any violations or deviations will eventually be legitimised through subsequent amendments. Such a regulatory culture encourages disregard for the law and undermines respect for planning institutions. Bengaluru is already witnessing widespread lawlessness in urban development, with inadequate infrastructure, recurring flooding, traffic congestion, pressure on water resources, and increasing safety concerns. At a time when stronger oversight and stricter standards are required, the proposed amendments move in the opposite direction by promoting greater density and reduced safeguards without corresponding investments in public infrastructure. This represents a serious abdication of the Government's responsibility to protect the public interest. The role of planning laws is not merely to facilitate construction, but to ensure orderly, safe, and sustainable development. Policies that prioritise short-term commercial interests over public safety, environmental protection, and the carrying capacity of the city risk accelerating the deterioration of Bengaluru's quality of life and exposing citizens to avoidable hazards. A modern city cannot be built on a foundation of weakened regulations and retrospective concessions. (Rule 9 of Rules 1878 for the Administration of the Forests and Wastelands in the territories of the Maharaja of Mysore). In a notification dated January 7, 1901, the area was declared as state forest under the Mysore Forests Regulations Act (1900) and was later deemed as reserved forest in 1963. THE SCAM: The #KIADB, the shady SCAM machine of the Karnataka Govt, is the usual suspect!! The Land Mafia in Karnataka, especially crooked Ministers utilise the shady bureaucrats of KIADB for their dirty schemes. This is how : * The Karnataka government’s Commerce and Industries Department acquired 305 acres and 23 guntas, "without noticing the nature of the land" in 1985 & 1987, under the provisions of the Karnataka Industrial Area Development Act to develop the Kadugodi Industrial Area! What kind of officials do not notice the nature of a forest land? Even if they are retired, they need to be brought back and prosecuted! * Another 141 acres was handed over to the Karnataka Industrial Area Development Board (KIADB) by the Mysore reserve Police in 1972. * Rumour has it that of 711 acres of Forest land, only 60 acres are left as forest. Kadugodi tree park is 22 acres and the Forest Dept opposite ITPL is some 37 acres.😢 ATTEMPTS BY FOREST DEPT TO RESTORE FOREST STIFLED: * In 2006, the joint Legislature committee set up to look into the encroachment of government land, headed by A T Ramaswamy, had surveyed this area and reported that Kadugodi Plantation Reserve Forest had been encroached upon by the Railways, KIADB, police department, animal husbandry department etc. * The original document of this property goes back to the notification of June 2, 1896 published in Mysore Gazette, described as Kadugodi Plantation in survey number 1 to the extent of 711 acres. * Digging into the old records, assistant commissioner, Bengaluru North, N Mahesh Babu, traced out the 1896 copy of the notification and put in place the layers of records, to finally prove that the land belongs to government and is a s a forest land. * Subsequently, RTC was entered into the Revenue Dept records, establishing 711 Acres as a forest land, in 2015! Subsequently, the Karnataka Forest Dept @aranya_kfd initiated process to recover the entire Forest land, however, it was blocked by vested interests.. There is a rumour that one of the affected beneficiaries of the encroachment challenged the recovery of forest land by the Forest Dept in the Supreme Court, and due to poor representation by the State Govt, the Supreme Court is supposed to have issued a stay or order against the recovery? This needs to be thoroughly investigated. How can the Govt be so careless about such an important matter? Just the way the Govt employs the most expensive lawyers to protect its derelict officials, or real estate interests, or to withhold elections to BBMP, cant it employ the best legal resources to save a forest? Bengaluru desperately needs this lung space! Whitefield in particular has become a concrete slum, with the lowest liveability parameters. In May last year, the forest minister @eshwar_khandre announced that the undeveloped parts of Kadugodi Reserve Forest will be recovered and restored. However, in December 2025, a massacre of trees ensued, and nearly 50 acres were deforested in just one month. WHAT PLANNING? DOES BENGALURU HAVE ANY PLANNING AT ALL? ONLY PROJECTS THAT ARE PART OF MASTERPLAN CAN BE CARRIED OUT BY GOVT! 1. If a project affects land use, zoning, or spatial development — such as: * new roads, flyovers, metro lines, or major infrastructure, * housing layouts or industrial areas, * changes to open spaces, parks, or lake areas, * reclassification of land (e.g., green belt to commercial), then it should be consistent with the city’s Master Plan (or Development Plan). In Karnataka, this is governed by the Karnataka Town and Country Planning Act, 1961 (KTCP Act). Relevant sections: * Section 13: Once a Master Plan (RMP/CDP) is sanctioned, all land use and development must conform to it. * Section 14: No change of land use can be made unless it’s in accordance with the plan or formally modified through due process (notification, objections, approval, etc.). * Section 15–17: Detail the procedure for modification of the Master Plan. 🟢 So all these projects such as Tunnel Roads, Elevated Corridors, Roads in Lake and Rajakaluve Buffer zones, etc., must either already appear in the Master Plan or go through a formal plan amendment. 2. Legal principle of “conformity” Courts (including the Karnataka High Court) have repeatedly held that: > Any development or project undertaken by any authority — public or private — must conform to the approved Master Plan. What a joke this tunnel obsession has become! Every day, a new alignment is announced, a new exit or entry point is altered. And all of this is done in the most ad hoc and whimsical manner. Even people building a small house on a 30x40 Site will have better planning than the ones heading this project. Stop this madness and build metro on time, give us better roads and complete the pending projects.
